House Rules and Terms of Service.

House Rules

To maintain a high standard of amenity for our Guests and neighbours the following conditions of occupation apply:

1. Use of Premises.
The premises are let for holiday purposes only and only for the period stated on the receipt.

2. No Smoking.
Smoking is not permitted inside the house.

3. Number of Guests.
The total number of Guests can NOT exceed the number stated on the Confirmation Notice unless subsequently agreed in writing by email. Additional fees will apply for excess guests not agreed with the Owner in advance and these will be deducted from the bond.

4. Parties, Gatherings and Functions are strictly prohibited.
The premises are located in a residential area of Byron Shire which has a strict NO PARTY POLICY for holiday letting. NO weddings, parties or large gatherings are permitted. Hen's Night groups or Buck's Party groups are not permitted.

5. Noise Restrictions Apply at All Times.
There is a history of unacceptable behaviours with some holiday letting in Byron Shire which has resulted in community sensitivity and the implementation of Noise Controls. We would like all of our guests to be respectful of our immediate neighbours and keep noise levels to a minimum while in the back or front yards. Quiet times for holiday letting are from 10 pm to 8 am and are enforceable by Byron Shire By-laws. Noise is to be kept to a minimum.

The Holiday Letting Organisation (HLO) is a private security company engaged 24/7 to enforce the Noise and Disturbance By-laws with mobile security guards who are empowered to issue Noise Orders and On-the-Spot Fines.

In the event of noise complaints from neighbours which result in either the HLO or Police call-out, or should a Noise Order be issued, the Owner reserves the right to immediately evict the Guest(s) and forfeit the remainder of their stay and also retain the whole of the bond without any refund.

6. Damage, Breakages, Theft and Loss.
The Guest is responsible for the Guest's own personal property including their mobile devices. The Guest is also responsible for the Owner's personal property, furnishings, fit-out items, decore items and objets d'art, provided within the house for the Guest's benefit and use. The Guest will bear the cost of repair or replacement of any such item in the premises or the premises itself due to damage and/or breakages, and any such cost will be deducted from the bond and may incur additional charges if the repair or replacement cost exceeds the amount of the bond. If the Guest notices any damage or that any item is broken, it must be reported to the Owner or the Owner’s agent upon the Guest's arrival. Damaged and/or broken items reported on or after the exit date will be considered damage caused by the Guest and will be deducted from the bond.

7. Departure Protocol.
i. Please ensure you vacate the premises by 10am (unless late departure has been previously arranged).
ii. The premises are to be left in a neat and tidy condition.
iii. All rubbish is to be removed from inside and placed in the bins provided. There will be a charge imposed for removal of additional rubbish.
iv. Please do not strip the beds.
v. The BBQ is to be wiped over, using the provided cleaning products. There is a $50 additional cleaning charge will apply if the BBQ is left dirty.
vi. Dirty dishes left for washing up are to be stacked in the dishwasher. Additional cleaning charges may apply.

8. Loss of Keys or Device Remote Control Units (Smart TVs, Aircon units, Ceiling fans).
The Guest will pay $150 Locksmith call-out fee charge plus $100 per remote control unit for replacement of remotes.

9. No Pets.
No pets or animals of any kind are permitted in or about the premises or house block.

10. Privacy and Security.
Your right to privacy is assured and the property has perimeter monitoring security cameras which are only turned on when the property is vacant. See here for more information.

11. No Variation.
Variations to these Terms and Conditions may only be made with the Owner or the Owner’s agent in writing.
